We assist in legal matters affecting New Mexico Public Education, such as providing assistance in developing and amending contracts, final decisions regarding educator license complaints and investigations; Legal appeals and litigation support.
We provide legal review for all Inspection of Public Records Act (IPRA) requests.
Why does the job exist?
The Law Clerk/Records Custodian will respond to multiple and continuous Inspection of Public Record (IPRA) requests and create a tracking tool to ensure all requests are responded to in a timely manner. This position will also work with the attorneys in the PED Office of General Counsel (OGC) to identify and provide requested records and follow all legal requirements when releasing
such records to members of the public making such requests. The Law Clerk/Records Custodian, under the guidance of the General Counsel, will comply with all statutes and regulations when releasing such records and must redact restricted information as required. This position will also be responsible for assisting PED's compliance with (1) the federal Health Insurance Portability and Accountability Act (HIPAA) (2) Family Educational Rights and Privacy Act (FERPA), and (3) the processes necessary for conducting background checks on PED's providers and employees.

Ideal Candidate
The person in the position must be well-organized, detail-oriented and thorough, able to work independently, accurate, able to follow through on all assignments, and have a team-oriented mindset. The person should have significant experience in organization and management of public records held by public agencies including reviewing, redaction and compiling public records and the processing of and response to public records requests. The person should have intermediate experience utilizing software programs utilized for the management and processing of public records requests such as Microsoft Office, Adobe Acrobat, and Windows Explorer. The person should have an understanding of court and/or administrative hearings and legal proceedings as well as experience editing and drafting typical court and administrative pleadings.
Minimum Qualification
Bachelor's degree in Paralegal, Legal Science, Business, English, History, Communications, Psychology, and/or Sociology and two (2) years of relevant experience to include the preparation and review of legal documents and legal/policy research and analysis. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling six (6) years may substitute for the required education and experience or current enrollment with at least two (2) semesters in a Juris Doctorate program from an accredited school of law will substitute for required work experience.
Employment Requirements
Must possess and maintain a valid New Mexico's Driver's License.
Working Conditions
Work is performed in an office setting with exposure to Visual/Video Display Terminal (VDT) and extensive personal computer and phone usage. Some sitting, standing, bending and reaching may be required.
